On Tuesday April 1, 2008, the Institute for Supply Management reported that its manufacturing index registered 48.6 last month, though a slower contraction than February’s 48.3, which had been the weakest in five years, still a sign that manufacturers are still struggling with less orders and increases in the cost of raw materials. The next day, the Commerce Department reported that home building fell for 24th straight month, and Bernanke told lawmakers that it “appears likely that gross domestic product will not grow much, if at all, over the first half of 2008 and could even contract slightly.” The week ended with Friday’s Labor Department's report showing a net loss of 80,000 jobs last month with manufacturing accounting for 48,000. One positive note in all the negative news was that the index measuring exports of our manufactured goods rose to 56.5 last month, up slightly from 56.0 in February. But, most analysts attribute that rise to the falling dollar. |

Q: I have a contract with a vendor that contains an arbitration clause. What is it and is it enforceable? She claims now that I cannot sue her.
An arbitration clause commits you to submitting to binding arbitration if a dispute arises. This prevents you from ever being able to take the company or business to court.
When to Look. Before you sign the contract! Once you have signed a contract, the arbitration clause is in full effect.Courts do uphold arbitration clauses.
Where to Look. The arbitration clause is typically located within the last five paragraphs of the contract or may be contained on a separate page. When you turn to the signature line, scan the last few paragraphs and look for a heading elated to “Disputes”, “Dispute Resolution”, or “Arbitration”. |

What does a 59-year-old white guy, like me, have to say about diversity? Well, unlike people of color, unlike women, unlike those whose gender preferences span unabashedly beyond the opposite sex, I've actually sat in meetings with the good-old-boys at the top as they discussed, derided, and denounced diversity. There were times when I spoke up and other times when, to my embarrassment, I remained silent.
While diversity in upper management has certainly not been achieved, I am here to tell you that the dialogue at the upper echelons has changed. When I talk and listen to the leaders of today, many of whom are still white men, they are speaking about diversity not as a necessary evil, but as an absolute necessity if their companies are to survive and thrive.
Because we compete in a global economy, U.S. corporations have been forced to trim the fat. Rare today are lavish expense accounts, layers of middle managers who have little to contribute except to interject another layer of bureaucracy, manufacturing lines where three people perform a job that could easily be done by two.

Construction projects can be simple, short term tasks or complex, multi-year endeavors involving millions of dollars. In major projects, numerous outside contractors (and subcontractors) are often hired, even if the overall project is awarded to a large well-known engineering or construction firm. Unless the project is insured in a Wrap Up program (all contractors, subs and subs of subs are insured under one contract for one job), then management cannot presume that all of their contractors are insured continuously through the period of the project.

Q: How can I protect my assets in Texas from a lawsuit?
A: Many assets are protected in Texas. For starters, a married couple can keep $60,000 worth of personal property. The limit is $30,000 for unmarried individuals. Homes located in Texas are also exempt from creditors' claims as long as it is located on 10 acres or less in town, or on 200 acres or less out of town, or 100 acres for individuals. There's no limit on the value of the homestead, so even a homestead worth millions of dollars is protected. If you owe money to the bank, though, on your home, your home can be foreclosed even if you have homestead protection. Be advised, the rules are different when involved in a bankruptcy.
Retirement accounts, 529 education accounts and life insurance cash values and annuities all have unlimited protection. After-tax contributions to non-Roth retirement accounts are not protected. Current wages are also protected, unless a court has ordered you otherwise (i.e. IRS back payments, child support, alimony or other support or maintenance). |
